We won

At long last, today we won. This morning in Maryland District Court, Judge William D Quarles Jr. approved the settlement.

Our attorney Stuart Davidson relayed the following:

Hearing was held this morning and Judge just entered an order granting final approval. One of your fellow class members showed up to voice his support for the settlement (he works around the corner from the courthouse). You should be getting your settlement payment directly from the claims administrator w/in the next 30-40 days.

If anyone knows how to write a press release, just let me know and I'll be glad to issue a statement. :wink:

"The checks, which will go out within a month, range from $10 to more than $10,000". So whose 4 months total fees = $10? More to point, have we heard any more details about what exactly counts as the 'monthly bill' in the phrase "four times their monthly bills"?

Guessing that $10 is likely one of the direct hosting end-user clients?
It's supposed to be the base fees before the variable "usage" fees like extra bandwidth/control panel extras/ shopping carts, etc...

Well long time "lurker" and first time poster here, and yes a former long-time Alabanza/NaviSite Employee, Guilty as charged!. I have read Alahost's since its conception both while I was at the company and since.

I have considered "un-cloaking" a few times over the years, however for various reasons, I never actually created an account of my own over here until now. I worked both in "Level 3 Technical Support" and "Sys" over the years, from Technical Support to Management so obviously have a unique perspective.

Alright to stay on topic, I think the settlement that was reached late last week is a great victory for those Alabanza clients who lost valuable business during the Migration Fiasco. There was no doubt that with the aquision of Alabanza came great ignorance from NaviSite's management with regard to the Alabanza Network Infrastructure and the realities of moving that infrastructure to Andover, MA. (Especially considering the mass exodus of staff, fleeing the company due to stability issues at the time).

Yes, it's true NaviSite did not understand what they purchased (other than the DSM software which was the sole asset they were interested in) until the day came to migrate "virtually" over the network, despite warnings from myself and others NaviSite maintained a "we have done this before, multiple times and have a professional migration team who have this down" attitude. Only they didn’t, and not unlike a transparent diesel generator when they finally hit the big green button, disaster ensued.

NaviSite could have consulted those of us who created and maintained the Alabanza network, they simply decided not to do so, that cost them a large percentage of its clients, plus a hefty lawsuit settlement, did they learn anything? Maybe. But then again I think they would tell you it’s just the cost of doing business.

On a side also as a beneficiary of the settlement, I would also like to applaud those who worked so hard towards a resolution!

I can confirm FedEx delivery of a check from the settlement fund today, June 9 2009. So it appears the checks really are in the mail at this time.

I bought out a company after the disaster. They wanted to send me the check but I wrote them a letter telling them to contact the old owner and I told the old owner to do the same.
